The agreement is short.

The app asks almost nothing of you, so these terms are almost nothing in return. Use it as intended, do not try to break it or resell it, accept that it comes with no guarantee, and understand that everything you write lives on your device and is yours to lose.

1. Who this is with

This agreement is between you and Lukas Gergel, Mestecko 137, 696 15 Cejkovice, Czech Republic — "we" or "us" below. "The app" means the Candle iPhone app and its home screen widget. By installing or using the app you accept these terms. If you do not accept them, delete the app.

2. Your license

We grant you a personal, non-transferable, non-exclusive license to use the app on Apple-branded devices that you own or control, as permitted by the Usage Rules in the App Store Terms of Service. The app is licensed to you, not sold.

3. Age

You must be at least 13 years old, or 16 where local law sets that threshold, to use the app.

4. What you write is yours

Anything you type into the app belongs to you. We claim no rights over it and never see it — it stays on your device, as described in the Privacy Policy.

Because there is no server, there is no backup we can restore for you. If you delete the app, lose the device, or reset it without a backup of your own, what you wrote is gone and we cannot recover it. That is the direct cost of the privacy the app is built around, and you should decide whether it is worth it to you before you write anything you would grieve to lose.

5. What you may not do

Do not copy, sell, rent, sublicense or redistribute the app. Do not reverse engineer, decompile or disassemble it except where law expressly permits you to despite this restriction. Do not remove or obscure any notice of ownership in it. Do not use it to break the law.

6. Price and subscription

Candle is free to download and to use. Lighting a candle is always free. An optional, auto-renewing monthly subscription unlocks a color of your own, a room of your own, and your own photograph behind the candle. Every background that ships with the app, and everything else — the candle, the burn, the notification and the history — remains free.

The current price and purchase details are shown by Apple before you confirm a subscription, and may differ by App Store storefront. Payment is charged to your Apple Account when you confirm. The subscription renews monthly until you cancel it. You can manage or cancel it in your App Store account settings; canceling stops a future renewal, and access continues until the end of the period you have already paid for.

Apple handles downloads, payments, taxes and refunds under the App Store Terms of Service. We never see your payment details. If you have bought a subscription before, the app can restore the access that Apple says is active for your Apple Account. When the paid period ends, the color, room or photograph you picked stays stored on the device; it stops being drawn and comes back if you subscribe again.

7. Ownership

The app, its name, its artwork and its code are ours or our licensors', and are protected by copyright and other laws. This license gives you the right to use the app; it transfers nothing else.

8. No warranty

The app is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not promise that it will be uninterrupted, error-free, or that a candle will always burn or a notification always arrive — iOS decides when apps and widgets are allowed to run, and we do not control that.

Nothing in these terms limits any statutory rights you have as a consumer that cannot be limited by agreement.

9. Limits of our liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid for it.

Candle is an object for marking something, not a reminder system, a medical device or a safety tool. Do not rely on it for anything that matters in that way.

10. Apple

This agreement is between you and us alone. Apple is not a party to it and is not responsible for the app or its contents.

Apple has no obligation to provide any maintenance or support for the app. If the app fails to conform to any warranty that applies, you may tell Apple, and Apple will refund the purchase price for the app; beyond that refund, Apple has no warranty obligation whatsoever. We, not Apple, are responsible for addressing any claim that the app fails to conform to a legal requirement, causes harm, or infringes someone's intellectual property rights.

You confirm that you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of this agreement and, on your acceptance of it, have the right to enforce it against you.

11. Ending it

You end this agreement by deleting the app. We may end it if you materially break these terms. There is no account to close, and nothing of yours is held anywhere for us to return.

12. Governing law

Czech law governs this agreement, and the courts of the Czech Republic have jurisdiction. If you use the app as a consumer resident elsewhere in the EU, this does not deprive you of the protection of mandatory consumer law in your own country, nor of the right to bring proceedings there.

13. Changes

If these terms change, the new version will be posted on this page and the effective date updated. Continuing to use the app after that means you accept the new version.
